RD Legal Funding Joins Other Companies Challenging CFPB’s Authority, Seeks To Dismiss Lawsuit

RD Legal Funding, LLC (RD Legal) and its affiliated companies recently filed a motion to dismiss the joint lawsuit by the Consumer Financial Protection Bureau (CFPB) and the New York State Attorney General’s office (NYAG). The motion seeks the dismissal of the complaint based on, among other things, the unconstitutional structure of the CFPB; the overreach by the CFPB in its attempt to regulate transactions over which it has no jurisdiction; and the improper characterization of RD Legal’s transactions as loans rather than true sales transactions.

During the course of the last several months, multiple media outlets have reported how other companies are pushing back against the CFPB’s overreaching as well as challenging the agency’s unconstitutional structure. In addition to RD Legal, Ocwen Financial Corporation, PHH Corporation, Pathfinder Payment Solutions, Prime Market Holdings, the Accrediting Council for Independent Colleges for Schools, and the State National Bank of Big Spring have challenged the CFPB’s overreaching. These companies have also argued the agency over stepped their authority, disregarded the law, and distorted the facts.  The U.S. Department of Justice has also argued that the CFPB’s structure is unconstitutional.

RD Legal Funding Makes Donation to Essex County Legal Aid Association

Cresskill, NJ – RD Legal Funding, LLC (“RD Legal”) recently made a donation to the Essex County Legal Aid Association, a 501(c)(3) nonprofit organization that provides free emergency legal services about civil matters to those who can’t afford it in the county.

Founded in 1906, the Essex County Legal Aid Association (“ECLAA”) last year helped 1,217 indigent clients from Newark, East Orange, Irvington and other county communities. Senior ECLAA attorney Ingrid Enriquez noted, “The majority of our clients seek and get our one-on-one help with landlord-tenant matters. We also help indigent people with consumer, family, individual rights, employment and income maintenance crises.”

ECLAA’s focus is providing immediate help with civil law emergencies. Ms. Enriquez noted, “If an ECLAA client needs representation after we handle the crisis, we will refer the client to relevant organizations.”

RD Legal Funding Gets Ready for BBBS’ Walk for Kids’ Sake

Joseph Genovesi, President of RD Legal Funding and Board Member for the Big Brothers Big Sisters (BBBS) of Bergen, Morris, Passaic and Sussex, is rallying up the team at RD Legal to participate in the Walk for Kids’ Sake for the second year in a row.

Last year, with the help of friends, family, and the RD team, Genovesi managed to raise over $1,500 for the Walk. This year he hopes to exceed that amount. The walk is being held on October 26th, 2014 at the Wyndham Worldwide Headquarters, 22 Sylvan Way, Parsippany, NJ.

The Walk for Kids’ Sake is an event held annually by BBBS in order to fundraise for its mentorship program and to celebrate its successes. Founded in 1904, BBBS operates in order to inspire, support, and motivate children by offering positive mentoring. Studies conducted by Public/Private Ventures have shown that children with a mentor of some sort are less likely to engage in dangerous, illegal, or otherwise detrimental activities, and are better able to thrive in a family environment.

Genovesi has been an active member of BBBS for over 13 years, and has been on the Bergen, Morris, Passaic and Sussex board since February 2013. He has been a mentor to the same child for over 13 years, and has seen the effects of positive mentoring firsthand.

6th Annual Walk for Team Walker

The 6th annual Walk for Team Walker is slated to take place on Saturday, June 21, 2014 at Exchange Place in Jersey City, New Jersey. Walkers can check in around 9:30 a.m. and the walk will commence at 11:00 a.m.

Team Walker is an organization that was started in 1996 by Jerry and Jasper Walker. The organization launched after school academic and athletic programs for youth in Jersey City that would provide safe and constructive choices to keep kids away from negative influences.

Team RD Legal Funding will be walking alongside teams from other companies around the Jersey City promenade to help raise funds for the organization. After the walk, there will be free food, face painting, live music, balloon twisting, and mascots.

Big Brothers Big Sisters 2014 Annual Gala

big brothers big sistersBig Brothers Big Sisters of Morris, Bergen, Passaic & Sussex, Inc. held their annual gala titled “A Celebration of Big Magic” on Thursday, May 15th, 2014. The event consisted of a cocktail reception, seated dinner, live music, and a silent auction.

The event was held to celebrate the volunteers who dedicate their time helping at risk youths get on or stay on the right path. Tom Fascia was named New Jersey’s Big Brother of the Year. The silent auction helped the fundraising efforts of the organization.

The gala took place at the Hanover Marriott in Whippany, NJ. The main honoree was B.J. Agugliaro, a Managing Partner for Pricewaterhouse Coopers, LLP. RD Legal Funding President, Joseph Genovesi, is currently a board member of the Big Brothers Big Sisters of Morris, Bergen, Passaic & Sussex.

RD Legal’s Twitter Account Hits 2500 Followers

At around 12:30 p.m. on April 1st, 2014, RD Legal Funding achieved a social media milestone when their Twitter account hit the 2,500 follower mark. RD Legal is proud to embrace this new technology and is enjoying the branding, traffic, and leads that come with a strong social media presence.

Slightly over a year ago on February 26th, 2013, the company’s Twitter account surpassed the 1,000 followers mark. Since then, growth has accelerated, acquiring 1,500 new followers in less than 13 months (it took about 2 years to hit the 1,000 mark).

The growth can be attributed to Lulaine Compere’s constant updating of the company Twitter profile, combined with utilizing Twitter’s promoted account product.

How Are You Giving Back For The Holidays?

happy-holidaysRD Legal Funding has been hit with the holiday bug. To celebrate the holidays, instead of throwing a raucous holiday party, we’re giving back to our community so that everyone can close out the year with a holiday bonus.

Following last year’s tradition, when we donated $1,500, we’re giving $2,500 to the Community Food Bank of New Jersey. This particular organization utilizes about 96 cents out of every dollar received to feed hungry families in New Jersey. Some of their programs include the BackPack Program, which provides full, nutritious meals to children who might not have enough to eat over the weekends; the Community Kitchen, which uses food from supermarkets that weren’t good enough to sell, but are certifiably good enough to eat; and the Mobile Pantry, which provides meals to under-fed people in areas with limited resources.

It’s easy to give back. Donating is one way to do it, but there are so many other ways to help your community. What are you doing this year to make a difference?
